1. Acceptance of Terms
By downloading, installing, or using Dayfall ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.
These Terms apply to all users of Dayfall, regardless of device platform or app version.
2. What Dayfall Is
Dayfall is a personal recall calendar app developed by Timeborns. It is designed to help you remember past days through photos, places, notes, and events — stored locally on your device.
Dayfall is a personal memory assistance tool. It is not a security system, financial record-keeping service, legal document tool, health monitor, or navigation application. Please do not rely on Dayfall as the sole authoritative record of any important event or information.
Dayfall operates with a local-first, no-login, no-server philosophy. There is no account registration. Your data stays on your device.
3. License to Use
Timeborns grants you a limited, non-exclusive, non-transferable, revocable license to use Dayfall for personal, non-commercial purposes on a device you own or control, subject to these Terms.
You may not:
- Copy, modify, or distribute the App or its components
- Reverse engineer, decompile, or attempt to extract source code
- Use the App for any unlawful purpose
- Use the App to monitor, track, or record another person without their knowledge and consent
4. Your Responsibilities
You are solely responsible for the content you store in Dayfall — including photos, notes, place records, and events.
Backups are your responsibility. Timeborns does not provide cloud backup or remote data recovery. Data stored in Dayfall may be lost if your device is reset, damaged, or replaced without a prior local backup.
You agree to use Dayfall only for your own personal recall and reflection. Using the App to track another person's location, schedule, or activities without their knowledge is prohibited and may be unlawful in your jurisdiction.
5. Permissions and Data
Dayfall may request system permissions including photo library access, location (including background location), and notifications. These permissions are used solely to support the app's core features, as described in our Privacy Policy.
All data processed by Dayfall remains on your device. Timeborns does not collect, store, or transmit your personal data to any external server.
6. In-App Purchases (if available)
Dayfall may offer optional in-app purchases ("IAP") to unlock additional features or remove advertising, if such functionality is made available. All purchases are processed by Apple (App Store) or Google (Play Store), subject to their respective terms and refund policies.
Timeborns reserves the right to change, discontinue, or modify in-app purchase offerings at any time. Refund requests for platform-processed purchases must be directed to Apple or Google through their standard support channels. Timeborns cannot issue direct refunds for platform-processed purchases.
7. Limitations and Disclaimers
Dayfall is provided "as is" without warranties of any kind, express or implied. Timeborns does not guarantee that the App will be error-free, uninterrupted, or that it will accurately capture all data you intend to record.
In particular:
- Location accuracy depends on your device hardware, OS settings, GPS conditions, and battery optimization. Location records may be incomplete or approximate.
- Background location detection may be affected by OS-level restrictions and cannot be guaranteed.
- Notification delivery depends on device settings and OS behavior.
- Data stored locally may be lost if the device is reset, lost, or damaged without a prior backup.
- Dayfall is a memory recall tool, not a complete or authoritative record of your activities.
To the maximum extent permitted by applicable law, Timeborns is not liable for any loss of data, indirect, incidental, or consequential damages arising from the use of Dayfall or the inaccuracy of any data it captures.
8. App Updates and Changes
Timeborns may update, modify, or discontinue Dayfall at any time. Updates may add new features, change existing functionality, or remove features.
Significant changes will be communicated through app store release notes or in-app notices where reasonably possible. Continued use of the App after an update constitutes acceptance of any revised Terms.
9. Termination
You may stop using Dayfall at any time by deleting the App from your device. Upon deletion, locally stored App data will be removed according to your device's standard app uninstall process.
Timeborns reserves the right to terminate or restrict access to the App for violations of these Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from your use of Dayfall should be directed to Timeborns via email in the first instance, so we can work toward a resolution.
